Elon Musk's AI Data Center Is Pumping Illegal Pollution Into Tennessee — and Residents Are Getting Sick

Data centers guzzle electricity, but a different kind of pollution is now drawing lawsuits in Tennessee. Elon Musk’s AI company — xAI, recently renamed SpaceXAI after merging with SpaceX — installed 59 natural gas turbines at its Colossus 2 data center without the required federal permits. The health data around the facility tells a troubling story.

Reuters broke the story Tuesday based on internal communications between xAI representatives and government regulators. The company had officially disclosed only 27 turbines at the Tennessee site in January 2026. The documents reveal 59 were actually installed and running.

The pollution math is staggering. Reuters analyzed 30 of the turbines and calculated they could emit 2,500 tons of nitrogen oxides, 4,000 tons of carbon monoxide, and 22 tons of formaldehyde each year. The Clean Air Act’s threshold for nitrogen oxides alone is 100 tons. These numbers blow past that by a factor of 25.

The NAACP has already filed a lawsuit against SpaceXAI. The complaint alleges that the unpermitted turbines increased local nitrogen oxide emissions by 111%, PM2.5 particulate matter by 83%, and formaldehyde by 88%. All three are respiratory hazards.

The health data around the data center is hard to ignore. Within a five-mile radius — roughly eight kilometers — 27 out of 28 census tracts show asthma rates above the county average. Twenty-four of those tracts also have elevated rates of chronic obstructive pulmonary disease. These are communities living downwind of one of the world’s most powerful AI training facilities.

The Colossus 2 data center is part of xAI’s rapid infrastructure buildout. Musk has made no secret of his ambition to scale AI training compute as fast as possible, and Tennessee has been a key location. But the gap between what the company disclosed and what it actually built is now the subject of litigation and public health concern.

This is not an isolated case. Data center construction across the United States has sparked backlash as communities push back against noise, water use, and now air quality risks. New York state recently became the first to pause new hyperscale data center permits. The Tennessee case adds an environmental justice dimension that regulators and hyperscalers will have to reckon with.
